Turkish paedophile faces new charges

Emin Baro, who was convicted of sexually molesting underage girls, has been remanded to Masaka Central Prison pending the hearing of a new case of aggravated defilement on November 1.


Baro, 54, was arrested on March 12 in Bugumba village, Iganga district after he was found in possession of a compact disc with videos showing two girls sucking his genitals.


He was yesterday arraigned before Grade One magistrate, Hood Matovu in Masaka Court, on charges of aggravated defilement.


Earlier in May, Baro was first tried at Nakawa Court in Kampala, where he was charged under the Computer Misuse Act.




The Act stipulates that a person who produces child pornography for the purpose of distribution through a computer commits an offence and is liable to 15 years on conviction or a fine not exceeding sh7.2m.


Baro pleaded guilty to the offenses and Grade One magistrate Rosemary Ngabirano charged him a fine of sh6m, which he paid and was acquitted.


But a few days later, High Court Judge Justice Faith Mwondha ordered for a retrial, on grounds that the case was mishandled.


She also noted that the disks, photographs and videos of child pornography recovered were not produced as exhibits in court for court to satisfy itself that it was child pornography.


Baro was, subsequently, rearrested and sent on remand to Luzira Prison. Court later resolved that the case be transferred to a court in Iganga district, where he allegedly committed the offenses.


However, Baro was instead taken to Masaka district after investigations by the Police discovered a girl reportedly defiled by him.


Sources say Baro, who claimed to be a Turkish national, had eluded Police since 2002 when rumours of his wicked acts came to light.


Sources reveal that Baro fled to Kenya and Tanzania, but often sneaked to Iganga, until Police arrested him this year.



High Court orders paedophile Emin Baro retrial

JUSTICE Faith Mwondha has ordered a fresh trial for Emin Baro, the pedophile recently convicted of sexually molesting under-age Ugandan girls.

The Nakawa High Court judge ordered for the retrial on grounds that the trial magistrate-Grade One, Magistrate Rosemary Ngabirano had overstepped her jurisdiction.

Ngabirano had sentenced Baro to a fine of sh6m or two years imprisonment.
Justice Mwondha said there was substantial evidence that the initial trial had been irregularly handled, hence the need for a retrial.   

She also said Ngabirano's ruling was lacking because there wasn't evidence key enough presented to court that Baro was guilty, much as Baro himself pleaded guilty.

"The disks, photographs, and videos of child pornography talked about were not produced as exhibits in court for court to satisfy itself that it was child pornography,' argued Mwondha.
She ordered that the fine of sh6m that Baro already paid be given back to him. He will return to court on May 22 to enter a plea.

However, following the irregularities in the case the Director of Public Prosecution (DPP) cited, Baro was remanded back to Luzira Prison.

Baro was arrested in March this year at Bugumba village, Iganga district.
Media reports also indicate that Baro was allegedly charged before Malindi Court in Kenya in 2009, after he was allegedly found having sex with a 15-year-old Kenyan girl.

He was reportedly charged before Senior Resident Magistrate Dominica Nyanibu. It is not clear how he left Kenya and entered Uganda.



Paedophile Emin Baro case to be transferred to Iganga Court

The case involving Emin Baro, who was convicted recently for molesting underage Ugandan girls, is set to be transferred to a court in Iganga district.

Chief magistrate Esther Nambayo who was presiding over the case at Nakawa court asked for the file to be transferred to Iganga Chief Magistrate’s Court on grounds that Baro committed the sexual offences in Iganga and therefore it has the geographical jurisdiction to try him

Baro, 54, was initially charged under the Computer Misuse Act. He was found in possession of a compact disc with videos showing two children sucking his genitals and arrested on March 12, at Bugumba village, Iganga district.

Before Nakawa court Grade One magistrate Rosemary Ngabirano, Baro pleaded guilty and he was fined sh6m which he paid.

Two weeks ago, High Courrt judge Justice Faith Mwondha ordered for aBaro’s retrial on grounds that Ngabirano had over stepped her powers and also mishandled the case.
