In Summary
In police hands. Dr Sam Lyomoki, who had not heeded summons to appear for questioning on Nebanda’s death, insists he has no case to answer.

After defying fresh summons on Monday, police yesterday picked up Workers’ MP Sam Lyomoki from the Naguru-based WBS television offices and took him to the Special Investigations Unit in Kireka for questioning.

Dr Lyomoki, who was arrested by plain-clothed officers, had been a guest on the TV’s Morning Flavor talkshow. He did not resist arrest.

At Kireka, Dr Lyomoki was immediately led to the SIU boardroom where journalists were barred from speaking to him.

However, when journalists got the opportunity to interview him through a window, he said he refused to voluntarily submit himself to police for questioning because he had no case to answer.

“I have already asked God to forgive the police because one of the officers who arrested me this morning told me that he was aware that what he was doing was not within the law but he had to obey orders,” he said.

Quoting Psalms 125:1, the lawmaker said he had forgiven the police because the Bible asks Christians to forgive those who persecute them.

Sharing pain

“I understand the situation of these police officers. So I dedicate to them Psalms 125:1 which states; Those who trust in the Lord are like Mt. Zion, which cannot be moved but abides forever,” the MP said, before journalists were asked to leave.

Dr Lyomoki’s arrest comes a day after the police announced that they would use all means to have him record a statement over comments he allegedly made on the postmortem report on the death of Butaleja Woman MP Cerinah Nebanda. Police said the MP overdosed on heroine and cocaine.

In Summary
The Workers’ MP says he was preaching the word of God in South Sudan and only got the summons from the Office of the Speaker.

Workers’ MP Sam Lyomoki yesterday snubbed fresh police summons over allegations of inciting violence. The deputy director of the Criminal Investigations and Intelligence Directorate, Mr Geoffrey Musana, had on January 7, written, inviting the MP to report to the commandant of the Special Investigations Unit in Kireka yesterday.

The MP instead addressed journalists at Parliament, where he revealed that he had just returned from South Sudan, where he had been “spreading the word of God”.

He said he received a call from the Speaker’s office, notifying him of police’s fresh summons.
“[But] I took a decision not to go after consultations and I am ready to be arrested because I have committed no crime,” Dr Lyomoki said.

He insisted that police came up with fake reports on the cause of death of Butaleja Woman MP Cerinah Nebanda and are now harassing them. Police reports indicated that the MP died after a drugs overdose.

“We all know that cocaine and morphine are inhaled. What was found in the MP’s stomach was poison. Police have lost the moral authority ... We should get an independent body to investigate the death of the MP,” he said.

Police last week also arrested Lwemiyaga MP Theodore Ssekikubo over claims of inciting violence.
Mr Ssekikubo was arrested days before he was due to appear for questioning and later released. Police had earlier summoned four MPs who allegedly made ‘inciting’ statements about Nebanda’s death.
Separately, the Workers MP yesterday also joined calls to the President to retire: “It does no harm for the President to retire. I have actually been nominated to coordinate the search committee to source for a leader to replace him.”

Kalungi wins stage one, declines to apply for bail

he Makindye Magistrate’s Court has struck the charge of supplying restricted drugs off the charge sheet in the case against Adam Suleiman Kalungi.

This is after lawyers representing Kalungi, the key suspect in the death of Butaleja Woman MP Cerinah Nebanda raised queries over the charge sheet.

Led by Mcdusman Kabega and Yunus Kasirivu, the lawyers argued that the charge of supplying and dispensing restricted drugs does not indicate the dates when the said drugs were supplied.

The lawyers also point to the fact that the charge sheet does not state who received the drugs or which specific drugs they are.

The Chief Magistrate Esther Nambayo agreed with the lawyers and has struck the charge off the charge sheet.

Kalungi now faces charges of man slaughter and unlawful possession of narcotic drugs.

He has however declined to apply for bail for fear of being re-arrested but his co-accused persons are currently applying for bail before the court.

The State attorney Samalie Wakoli says investigations in the case will be completed within 2 weeks.

The court has also granted a request by the lawyers to be furnished with all police statements, including those made by the accused and all witnesses as well as all exhibits before the next court sitting.

The case has now been adjourned to February 5th when the Magistrate shall rule on whether or not to grant the five suspects bail.

This is after the state objected to their bail application saying they are most likely to abscond because it took such a long time for them to be arrested.
