High Court in Kampala yesterday sentenced Francis Birungi Binaisa, son to former President Godfrey Lukongwa Binaisa to 12 years imprisonment for aggravated defilement.

Binaisa was last year charged with defilement when he sexually molested his 12-year niece between November, 2010 and April last year at Luvuma Zone in Makindye Division.

Justice Rugadya Atwoki said Binaisa was entrusted by the victim’ s parents to take care of their daughter but instead molested her.

The victim told court that Binaisa abused her three times.

Justice Rugadya in his ruling said prosecution proved beyond reasonable doubt that the act of sex was performed.

“The evidence the victim gave on sworn in-oath collaborates with the evidence of Dr Moses Byaruhanga, who examined the girl, found she was 13 years old and her hymen was ruptured hence sufficient intelligence,” the judge said.


No defence

Justice Rugadya also said the accused refused to give his defence after telling court many times that he was unwell and needed more time to get treatment.

0n June 20, Binaisa was ordered to give his defence and still insisted that he was unwell and therefore need more time to get treatment and access his witnesses in Kyenjojo District.

However, Court dismissed the application, saying there had been many adjournments on the same issue since last year.

His lawyer, Mr Yunus Kasirivu, however, told court that they intend to appeal since his client said he felt the trial has been based on a biased judgment.

A UPDF soldier attached to Second Division Makenke barracks in Mbarara district has been sentenced to four years in prison over aggravated defilement.



Private Hannington Nuwamanya, 44, a father of two, was convicted by the Division’s court martial presided over by chairman, Col. Geoffrey Mujuni for defiling an 11-year-old girl at Makenke barracks.



State Prosecutor, Lt. Gerald Bamwitirebye, told court that on November 7, 2009, Nuwamanya defiled, a neighbors’ daughter as she was away to fetch water.



 The victim, who was in primary four at Mbarara Army Primary School, was called by the convict into his house and defiled her.  



Nuwamanya, who joined UPDF in 1989 from Bushenyi district, was arrested and the victim examined by Dr. Christopher Monday Araali of Mbarara referral hospital after two days.



Medical report revealed that there was only a penetration in her private parts.  



However, Nuwamanya, who did not plead guilty and denied the allegations. He told court that he was framed by the victim’s mother who had a crash on him but ignored her.
